3. Book Creation and Content

3.1 User Content

When creating personalized books, you may provide information about children, select themes, and choose life lessons. You represent and warrant that:

  • You have the right to provide all information submitted
  • The content you provide does not violate any third-party rights
  • You have parental or guardian consent if providing information about minors

3.2 AI-Generated Content

Our books include AI-generated stories and illustrations. While we strive for quality and appropriateness, AI-generated content may occasionally contain errors or unexpected elements. You acknowledge that:

  • AI-generated content is provided "as is"
  • We do not guarantee perfect accuracy or suitability for all audiences
  • You should review all content before sharing with children

4. Intellectual Property

4.1 Your Rights

You retain ownership of any personal information you provide. By using our services, you grant us a non-exclusive, worldwide, royalty-free license to use your provided information solely for the purpose of creating your personalized books.

4.2 Our Rights

All AI-generated stories, illustrations, and other content created by our system remain the property of CreateMyCookbook LLC, DBA Talezy. You receive a personal, non-transferable license to use the books you purchase for personal, non-commercial purposes only.

5. Prohibited Uses

You agree not to:

  • Use our services for any unlawful purpose
  • Submit false or misleading information
  • Attempt to reverse engineer our AI systems
  • Resell or commercially distribute books without permission
  • Use our services to create inappropriate content for children
  • Violate any applicable laws or regulations

6. Payment and Orders

6.1 Pricing

All prices are listed in US dollars and include applicable taxes unless otherwise stated. Shipping costs will be calculated and displayed during checkout.

6.2 Payment Processing

We use Stripe to process payments. By providing payment information, you authorize us to charge the total amount for your order. All payment information is handled securely according to industry standards.

6.3 Order Acceptance

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or concerns about fraud or unauthorized transactions.

7. Shipping and Delivery

Physical books are printed and shipped by our third-party fulfillment partners. Delivery times and shipping policies are detailed in our separate Shipping Policy. Digital products are delivered electronically to the email address associated with your account.

8. Returns and Refunds

Our return and refund policies are detailed in our separate Return Policy. Due to the personalized nature of our products, returns are limited to cases of defects or errors in production.

10. Disclaimers and Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATEMYCOOKBOOK LLC, DBA TALEZY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM OR $100, WHICHEVER IS LESS.

11. Indemnification

You agree to indemnify, defend, and hold harmless CreateMyCookbook LLC, DBA Talezy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of our services or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms.
